A fire helmet belonging to Dan Dellorto disappeared while at an incident.  Admin is docking his pay to cover the cost of replacing the helmet.

Dellorto maintains that since past incidents of lost or damaged equipment have occurred in which the members responsible were NOT made to pay for the damage, he is being disciplined too harshly.  Dellorto is asking for a lower level of discipline that is more consistent with the infraction.

GRIEVANCE:  that the Member (D Payne) was given an unfounded Disciplinary Action based on not passing the PAT test accdording to the standards established by the Administration

REMEDY SOUGHT: removal of the Written Warning of Corrective Action from the employee's record

ADMIN:  opines that the action is within their scope of authority and that no grievance exists

STATUS:  Settled.  Admin withdrew the written disciplinary action and instead used a written notice of verbal counseling.  Payne agrees that this is satisfactory.

GRIEVANCE:  Member was not allowed to move up to higher rank when vacated as outlined in the Rules and Regulations.

REMEDY SOUGHT: Establishment and enforcement of written policy; differential pay for days not allowed to work out-of-rank.

ADMIN agrees to written policy; denies paying the back differential.

STATUS:   Withdrawn in late October 2011.

Grievance 10-01, only Appealed at the Feb 2010 Meeting and with new material to consider

UPDATE:  Grievance has failed in Committee.  After long consideration, the Committee concluded that A) the test was indeed binding, since it was posted and processed by the NLR Civil Service Commission, and B) the overall testing system was poorly designed and administered, but not enough so as to invalidate the test or to give cause to have another retest.
